Using my video?

Then it’s polite to ask first. And illegal not to.

Yet that’s exactly what the pisspoor banvuvuzela.com has done. Illustrating their site with my video.
Without asking.
And what’s more, it’s promoting a cause which I wholeheartedly disagree with – namely a pathetic and pointless campaign to ban vuvuzelas from the FIFA World Cup Finals in South Africa next year. Well, I say that – in actual fact it’s a poorly designed, atrociously coded effort to attract hits and get people to click on their ads. So don’t.

But down the bottom there? That’s my video of the teams emerging from the tunnel at Newlands on the 9th September 2007celebrating the vuvzela,  which was enjoyed by everyone at one of the most multiracial events I have ever attended in SA. There is no way I would ever have agreed to have my video on their site. Even if they’d bothered to ask.

“They”, by the way, is Mr Hilton Preston of Montagu in the Western Cape. He and his Mrs (Ronel) run a little self-catering place in that sleepy hollow, as well as him wasting his time devising silly online petitions. If you should want their phone number, email or even home address, I’m happy to supply them.

Incidentally, I was alerted to the site by Rob Vember on 5fm last night. He advocates boycotting the businesses that advertise on the site as being a good way of showing one’s displeasure. I would agree, but I would also ask you to take the time to email the businesses concerned and tell them what you are doing and why.

Just DON’T CLICK ON THE ADS to get there – that will only benefit copyright thief Preston, who says in his disclaimer that he:

…owns the intellectual property rights in the website and material on the website.

Ooh – you liar!

Now, I could go in all guns blazing, but I won’t. Rather let’s use the softly, softly approach here. Having posted this, I’m going to use YouTube to annotate my video – put little pop-up messages on there. That way, the video remains on banvuvuzela.com, but I get to put my message(s) across. I don’t know how long it will last on there, but it’ll be fun while it does. Oh, and thanks to BoastBoy for his advice on this.

However, if you don’t want to give Mr Preston any more traffic, you can always just watch the video here. And I will be putting the annotated version on this post once I have annotated it. Done:

    my my, how easy it is to step on someone’s toes these days. I will start by apologising for the use of your video, I replaced it the second I saw your message.

    My understanding is that if YouTube offers one to embed a video, that it is available for anyone to use. Also, when I first found the video, I was under the impression you were also against it, clearly I was wrong.

    We come from very different views here, which is great, each to his own! I must thank you however for sending so many people to my site, my referal system shows most of them actually voted.

    I am in no frame of mind to start an online war, I have better things to do. So once again, sorry, and good luck promoting the vuvuzela! Enjoy the World Cup!

    And re: the disclaimer – part of it is under Californian law, part under English and Welsh. None of it under Sharia law, thank goodness.

    Blind Cripple > The ESPN guys are perfect for the site. Because much like banvuvuzela.com, no-one actually gives a toss what they think.

    Hilton > Welcome to the 6000 miles… family. Agreed that what is on youtube is happily embeddable, but politeness or a little resarch (ie. looking at the description of the video on youtube) would have led you to ask, ne?
    I recognise that we come from different viewpoints and also, I applaud that difference. Especially as I’ve already won this battle by having FIFA, the LOC and SAFA firmly in my camp. Get as many votes as you want – currently you haven’t even managed to match the smallest Confederation Cup attendance. Even if you get a million, it won’t make a jot of difference.

    So I’m glad you have better things to do with your time, although your previous behaviour doesn’t really support this. But as I have noted in this post – this isn’t about getting vote against the vuvuzela, it’s about getting hits on your ads, isn’t it?

    I hope that you, too, enjoy the World Cup. Just presumably with the sound turned down.

    6000, you make a mountain out of a molehill.

    If you don’t want your video being embedded on websites around the internet, then don’t upload them to YouTube and make them public. Upload to your own server. Otherwise, deal with it and stop bitching and moaning.

    Methinks you’re making a scene to generate traffic – the same thing you’re accusing the guy in question of (not that I agree with his stance).

    Meh – I don’t need to generate traffic – I don’t have budgets to meet or people to please. I write about what I want and this what I wanted to write about.

    Which of course you would never have done, knowing full well that you’d end up looking like a fool (because your video was used without your permission, regardless of personal messages inserted into it, after uploading it to a public video sharing website).

    The heading of this article is “Using my video” and that seems to be the issue, right? If you select the option to make your video public, the embed code is there for anyone to use. And it is not illegal. Either make it public, or upload it to your server and then link it to your site.

    What is illegal though, is you asking people to click on adverts – even if you jokingly refer to it. Go read the Youtube terms and conditions and then for good measure, your AdSense terms and conditions.

    Just some friendly advice.
